Welcome to bookd!, hereinafter referred to as the "Website", "Site", "Platform", "we", "us", or "our."

The Website is offered subject to your acceptance of the terms, conditions and notices contained herein (the "Terms"). By accessing or using the Website you agree to be bound by these Terms.

The Website is an online platform that allows Clients to search, cast, book and pay Talent through Talent profiles. Talent profiles are created, shared and updated by the Talent themselves.

By accessing or using the Site you agree to comply with and be legally bound by these Terms of Service. These Terms govern your access to and use of the Site and Services and constitute a binding legal agreement between you and bookd!.

We may update these Terms at any time by posting revised Terms on the Website. Continued use of the Website constitutes acceptance of the updated Terms.

If you disagree with the Terms you must discontinue using the Website.

"bookd!" means the online platform that provides a venue for Clients to search, cast, book and pay Talent.

"Account" means an account created by a User to access the Services.

"Talent Account" means an account created by Talent in order to display a profile and receive bookings.

"Client Account" means an account created by a Client to search, cast, book or hire Talent.

"Client" means a recruiter, casting director, brand owner, advertising agency, photographer, production company, or other entity seeking Talent for a job.

"Talent" means a User who performs work including but not limited to models, actors, dancers, singers, emcees or voice over artists.

"User" means any individual who visits or uses the Website.

"Content" means text, images, videos, graphics, audio or other materials uploaded or displayed on the Website.

"User Content" means all Content uploaded, published or transmitted by a User.

The official language of these Terms shall be English.

bookd! acts solely as an online marketplace platform connecting Clients and Talent.

bookd! is not:

• an employment agency
• a talent agency
• a casting agency
• a manager or representative of Talent
• a production company
• an employer of Talent

All engagements, contracts and working relationships are entered into directly between the Client and the Talent.

bookd! does not guarantee:

• employment opportunities
• bookings
• auditions
• income
• casting success
• any minimum number of bookings or earnings within any period of time.

bookd! does not supervise, direct, or control the performance of Talent and is not responsible for the quality, conduct, or outcome of services provided by Talent.

Any previous promotional offers, guarantees, or representations that may have existed on earlier versions of the platform no longer apply unless expressly stated in writing by bookd!.

Use of the Site is available only to persons who can form legally binding contracts under applicable law.

Users must be at least 18 years old to create an Account.

If a Talent is under the age of 18, the Account must be created and managed by a parent or legal guardian.

bookd! allows Talent under the age of 18 to participate only with the involvement and consent of a parent or legal guardian.

If a Talent is under the age of 18:

• the Account must be created and managed by a parent or legal guardian
• the guardian accepts these Terms on behalf of the minor
• the guardian is responsible for supervising all bookings and activity

Clients are responsible for ensuring compliance with all child labour laws, permits and regulations in the relevant jurisdiction.

bookd! does not verify parental authority and relies on the representations made during registration.

Users must create an Account to access certain services on the Website.

You may be required to provide personal information including:

• name
• email address
• photographs and video
• contact details
• payment details

You agree that all information provided is accurate and truthful.

You are responsible for maintaining the confidentiality of your login credentials.

Users may not:

• impersonate another person
• create false accounts
• transfer or sell their Account
• create multiple Accounts

bookd! reserves the right to suspend or terminate any Account that violates these Terms.

bookd! may request identity verification at any time.

Clients may search, shortlist, cast or book Talent through the platform.

Once a Talent accepts a booking request a Job is created.

Clients and Talent may communicate through the platform regarding the Job.

Users agree not to circumvent the platform by arranging bookings or payments outside bookd! for engagements introduced through the platform without the prior written consent of bookd!.

Clients are responsible for organising all aspects of the production or event including:

• location
• scheduling
• permits
• safety requirements
• insurance

Clients must ensure a safe working environment for Talent.

Clients must obtain appropriate insurance including public liability insurance.

Clients are solely responsible for the conduct, supervision, and management of any production or event associated with a booking.

Clients are solely responsible for obtaining all necessary rights, releases, and permissions required for the use of Talent images, likeness, voice, or performances in any media or campaign.

Talent agrees to:

• provide accurate profile information
• attend confirmed bookings
• perform services professionally
• comply with job requirements and lawful instructions

Failure to attend confirmed bookings may result in:

• disputes
• account suspension
• termination of the account

bookd! facilitates payments between Clients and Talent.

If a job is cancelled within 72 hours of the scheduled job time, a cancellation fee of 30% of the total job value will apply.

Cancellation fees may be deducted from any deposit paid or invoiced to the Client if not already collected.

Users retain ownership of their Content.

By uploading Content to bookd! you grant bookd! a non-exclusive worldwide license to display and use such Content for the operation and promotion of the platform.

Users must ensure they have the legal rights and permissions required to upload all Content.

Users may not upload:

• explicit sexual content
• unlawful content
• copyrighted material without permission
• content depicting minors in inappropriate situations

bookd! reserves the right to remove content at its discretion.

bookd! may suspend or terminate any account if:

• Terms are violated
• fraudulent activity is suspected
• unlawful behaviour occurs
• platform abuse occurs

The Website is provided "as is" without warranties.

bookd! does not guarantee:

• uninterrupted service
• error-free operation
• successful bookings

Users use the platform at their own risk.

bookd! does not guarantee that the platform will always be available or free from interruptions, delays, or technical errors.

To the fullest extent permitted by law, bookd! shall not be liable for:

• indirect or consequential damages
• loss of profits
• loss of business
• disputes between Users

Total liability shall not exceed the amount paid through the platform for the relevant booking.

bookd! shall not be liable for any acts, omissions, or conduct of any User, Client, or Talent arising from or related to any booking, production, event, or engagement arranged through the platform.

Any disputes shall be resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC).

The arbitration award shall be binding.

bookd! shall not be liable for failure to perform obligations due to events beyond its control including:

• natural disasters
• internet outages
• strikes
• civil unrest
• system failures
